Respondent, a medium dairy CAFO in Whitney Point, New York failed to implement CNMP practices in response to high risk practices, had inadequate freeboard at the manure storage structure and failed to properly operate and maintain the silage leachate collection system in violation with the terms and conditions of the NYSDEC CAFO General Permit. An Administrative Order was issued on June 1, 2011 (CWA-02-2011-3036) to order the facility to comply with Permit conditions. This Order establishes a revised compliance schedule for construction of the silage leachate collection system due to flooding damage that occurred at the farm subsequent to the EPA inspection on 4/6/11. Injunctive relief and pollutant reduction calculations associated with this case have been incorporated in the previous AO (CWA-02-2011-3036).
