EPA Region 10 settles FIFRA Case Regarding Late Reporting of Annual Pesticide Production
On August 23, 2011, EPA reached a settlement with Bio-Gro, Inc., in the amount of $3,300.00 for violations of FIFRA Section 12(a)(2)(L). Bio-Gro, Inc., located in Mabton, Washington, has submitted late annual pesticide production reports twice in the last three years. The establishment (EPA Est. No. 082041-WA-001) failed to submit its 2007 annual report by the March 1, 2008, deadline. A Notice of Intent to Terminate - Notice of Warning was issued in 2008 which notified the company that a civil penalty would be issued if their annual report was not received and if they were late again in the following three years. The 2010 report also was submitted after the deadline and was not received until after further notification was sent to the company on June 2, 2011.
EPA worked with Bio-Gro, Inc., to bring their establishment into compliance according to Section 7 of FIFRA and to provide the necessary information to minimize future violations.
