Stimson Lumber Company is a wood products facility located in Plummer, Idaho, within the exterior boundaries of the Coeur dÂAlene Indian Reservation. Stimson Lumber Company failed to submit a timely permit renewal application at least six months prior to the date of expiration of its Title V air operating permit. Stimson subsequently submitted a complete application approximately one month overdue and is awaiting permit reissuance by EPA. The operation of this facility without a Title V Permit is a violation of Section 502(a) of the Clean Air Act, 42 U.S.C. § 7661a(a) and Title V Part 71. EPA is proposing to issue an Administrative Order on Consent to the company to operate its facility under an enforceable compliance schedule, until such time that the Title V Permit is re-issued.
