Respondent owns and operates the facility in Ballston Spa, NY. Stormwater associated with industrial activity from this Facility is discharged into Ballston Creek, a navigable water of the US via direct surface runoff and two (2) storm drains located on the property. A duly authorized representative of EPA conducted an inspection of the facility on 6/8/2010. The facility failed to obtain coverage under the NYSDEC SPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity.
