Summary

This case addresses violations of the Clean Air Act (CAA) by Business World USA, LLC, a business services company located in Miami, Florida. On August 18th, 2010, Business World imported into the United States 24 diesel generators which were not covered by an EPA-issued Certificate of Conformity (COC). The generators contain stationary diesel internal combustion engines governed by 40 C.F.R. Part 60, which requires that they be certified according to the standards and procedures in 40 C.F.R. Part 89 (i.e., that they be covered by a COC) due to their size and model year. Business World declared on EPA Form 3520-2 1 (by checking code 13 ) that the Subject Engines satisfied the importing for eventual export exemption to the certification requirement. However, none of the Subject Engines were labeled to indicate that they are not certified for sale or use in the United States as required by 40 C.F.R. section 1068.230(c). Business World agreed to pay a penalty of $21,000 and to either export or destroy the 24 uncertified engines.
