On September 15, 2011, EPA Region 10 filed a Consent Agreement and Final Order (CAFO) to initiate and simultaneously resolve an administrative action filed under Section 313 of the Emergency Planning and Community Right-to-Know Act of 1986, (EPCRA) with respondent Chemco, Inc. EPA alleged that Chemco, Inc., a manufacturer of fire retardant wood treatment chemicals located in Ferndale, Washington, violated Section 313 of EPCRA and 40 C.F.R. Part 372 by reporting incorrectly for methanol for calendar year 2005 and failing to submit timely Toxic Chemical Release Inventory Reporting Forms (ÂForm RÂ) for methanol and formaldehyde for calendar years 2007 and 2008. Chemco, Inc. has agreed to pay a penalty of $25,400.
