An EPA inspection of the facility in February 2011 revealed numerous violations of Risk Management Plan implementation requirements as required by CAA section 112(r)7 and 40 C.F.R. Part 68. Using its Expedited Settlement Agreement (ESA) authority, EPA was able to offer Fresh and Easy reduced civil penalties totaling $6,700.
