This case addresses violations of the Clean Air Act (CAA) by Sullivan Fuel Company, a petroleum marketer out of Bath, Pennsylvania. EPA alleges that Sullivan violated 40 C.F.R. sections 80.610(a) and 80.612(a) by selling, offering for sale, dispensing, supplying, offering for supply, storing or transporting heating oil for use in nonroad vehicles or engines, and causing the violation detected at Atlantic States Cast Iron Pipe Company, a wholesale purchaser-consumer, located at 183 Sitgreaves Street, Phillipsliurg, NJ.
40 Code of Federal Regulations section 80.610(a) prohibits the use of heating oil in nonroad engines. 40 C.F.R. 80.612(a) prohibits causing another person to use heating oil in nonroad engines.
As part of the settlement with EPA, Sullivan has agreed to pay a $10,000 civil penalty.
