Region 5 is entering into a Consent Agreement and Final Order with Fred Radandt Sons, Inc. resolving Clean Air Act violations. The violations were referred to the region by Wisconsin Department of Natural Resources. The company failed to apply for construction and operation permits as required by the Wisconsin SIP to operate fifteen separate pieces of mineral processing equipment. Fred Radandt Sons also did not conduct performance testing on the equipment as required by the New Source Performance Standards for Nonmetallic Mineral Processing Plants, Subpart OOO. Fred Radandt Sons was issued an NOV/FOV for these violations on September 11, 2009. Fred Radandt Sons has applied for and received the necessary construction and operation permits and completed required performance testing. Fred Radandt Sons will also pay a civil penalty of $60,000 to resolve the violations.
