This is a CERCLA §109 penalty action for Respondent's failure to promptly notify the NRC of its May 15, 2009 release of anhydrous above the reportable quantity (RQ) as set out at CERCLA 104. A CAFO has been negotiated/signed and entered which requires Respondent to pay civil penalties in the amount of $23,700.
