This case addresses violations of the Clean Air Act (CAA) by Atlantic States Cast Iron Pipe Company (Atlantic States), a cast iron pressure pipe and fittings manufacturer out of Phillipsburg, New Jersey. EPA alleges that Atlantic States violated 40 C.F.R. sections 80.610(a) and 80.612(a) by selling, offering for sale, dispensing, supplying, offering for supply, storing or transporting heating oil for use in nonroad vehicles or engines.
40 Code of Federal Regulations section 80.610(a) prohibits the use of heating oil in nonroad engines.
As part of the settlement with EPA, Atlantic States has agreed to pay a $10,000 civil penalty.
