This enforcement action was filed in response to discoveries made during EPCRA 311/312 compliance inspections conducted on 7/30/2008 at the Mokena facility as well as two Ozinga sites in Chicago, IL. Each of these facilities had diesel fuel in quantities over the reporting threshold. None of these sites had submitted Tier II forms for diesel fuel for calendar years 2006 and 2007 to their SERC, LEPC and local fire departments.
