Respondent, Morningstar Minerals Corporation, owned or operated a humate mill and manufacturing facility, located in Farmington, San Juan County, New Mexico. Respondent did not submit a Notice of Intent for permit coverage for its activities at the facility, and was not covered by a NPDES permit at the relevant times for the relevant activities. The violations were identified during a storm water State inspection conducted on June 28, 2011, by NMED.
