Region 1 settled a Clean Water Act administrative penalty action against Red Shield Acquisition LLC dba Old Town Fuel & Fiber (Red Shield), a pulp mill located in Old Town, Maine. The settlement alleges that Red Shield discharged untreated wastewater into the Penobscot River without a permit and failed to comply with the terms and conditions of its Maine Pollutant Discharge Elimination System (MEPDES) permit and its MEPDES Multi-Sector General Permit for Stormwater Discharge Associated with Industrial Activity. The company also failed to properly maintain and implement a Spill Prevention, Control, and Countermeasure Plan. The settlement requires Red Shield to pay a civil penalty of $126,000. Concurrently, EPA issued a Findings of Violation and Order for Compliance on Consent to Red Shield under which the company agrees to undertake certain specified injunctive relief.
