On December 12, 2011, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to RCRA 3008(a) to Bayport Processing, LLC (Bayport), located in Pasadena, TX. The 3008(a) CAFO was issued to modify an existing 7003 Adminstrative Order on Consent (RCRA-06-2005-0197) and to conditionally terminate an exisitng CAFO (RCRA-06-2006-0902). The 3008(a) CAFO requires Bayport to identify, investigate, remedy, and/or prevent the potential endangerment to human health and/or the environment from activities involving solid waste and hazardous waste in accordance with 40 CFR 264. Bayport must respond to EPA Region 6 by January 30, 2012. For more information, see documents below.
