On August 13, 2012, EPA entered into an Expedited Settlement Agreement with North East Refrigerated Terminals, Inc. for alleged violations of Section 112(r) of the Clean Air Act. EPA determined that the facility had failed to resubmit its risk management plan within five years as required under Section 112(r)(7) of the Risk Management Program regulations. North East Refrigerated Terminals operates a freezer warehouse in Middleboro, Massachusetts. The facility has corrected the violation and paid a penalty of $1,200.
