On February 17, 2012, EPA Region 6 issued an Administrative Penalty Order (APO) under its authority pursuant to the Clean Water Act (CWA) to Perdue Commercial Disposal, LLC (Perdue) located in El Dorado, AR. The APO was issued in response to violations of Section 301 of the CWA, 33 U.S.C. Section 1311. The APO requires Perdue to pay a proposed penalty for the unauthorized discharge of oil field brine to Mill Creek, a water of the U.S.
Perdue agreed to settle the APO by paying a monetary fine.
