As described in paragraphs 11-13 of the Motion to Withdraw Administrative Complaint filed with the RHC on July 2; 2004; on Jan. 30; 2004; the Honorable John G. Heyburn; II (Chief Judge of the U.S. District Court for the Western District of Kentucky); issued an order directing the pro rata distribution of funds to general unsecured creditors.
On June 10; 2004; U.S. EPA; Region 5; received its pro rata distribution of funds from the Bankruptcy Case in the amount of $18; 600.00.
Respondent has fully complied with its responsibilities under the Settlement Agreement.
Based on the above; and pursuant to the terms of the Settlement Agreement; Complainant hereby moved to withdraw the Administrative Complaint in this administrative action.
Order signed July 7; 2004 by ALJ and filed September 9; 2004 with the RHC dismissing Administrative Complaint.
