Respondent on June 25, 2010, submitted a voluntary disclosure under the EPA audit policy for the Emergency Policy Policy Community Right to Know Act (EPCRA) Section 312, for failure to submitting complete Tier 2 Reports. Based on information provided by the Respondent, EPA has determined that the facility meets the conditions of the Audit Policy for 100% elimination of the total gravity-based penalties. The violations that qualify for relief under the Audit Policy have been corrected by the Respondent.
