Respondent owns/operates the concrete ready-mix facility located in Oneonta, NY and was operating without coverage under the NYSDEC MSGP or an Individual Permit at the time of EPA's August 1, 2011 inspection. Based on site conditions at the time of the inspection, stormwater could leave the site, discharging through the NYSDOT storm sewer system, to a sediment basin, pond and Susquehanna River.
