Region 5 filed a Consent Agreement and Final Order (CAFO) commencing and concluding an Administrative Penalty Proceeding against The DeLong Company (DeLong), which owns a grain elevator in Channahon, Illinois. DeLong processes grains and emits PM, PM-10 and PM 2.5 at its facility in Channahon, Illinois. The Region alleged that DeLong failed to obtain an operating permit, failed to implement PM controls on its internal transferring operations, failed to control dust and delayed performance testing for fugitive PM operations at its facility.
Under the terms of the CAFO, DeLong agreed to pay a civil penalty of $36,000 and to perform Supplemental Environmental Projects (SEPs), at a cost of at least $160,013 by: 1) installing PM controls at the soybean loadout area of the facility, including conveying PM from the soybean loadout area to a baghouse for treatment; and 2) providing an asphalt cover over its roads.
