On August 9, 2012, Region 1 filed a consent agreement and final order (CAFO) that simultaneously initiated and settled an enforcement action against Christmas Tree Shops, Inc. (CTS) for violations of EPCRA and the associated federal regulations at 40 C.F.R. Part 370. An EPA inspection at CTSÂ warehouse in Middleborough, Massachusetts revealed that the company was storing diesel fuel, lead and sulfuric acid in quantities above the applicable minimum threshold levels and had failed to file the required Tier II forms for these chemicals for calendar years 2007-2009. Under the terms of the CAFO, CTS will pay a penalty of $26,325 to resolve the alleged violations.
