On September 23, 2011, EPA issued a Notice and Findings of Violation to Harsco for violating its FESOP and the IN SIP. Specifically, Harsco failed to prevent visible particulate matter emissions from leaving its building enclosing material processing equipment, failed to have its baghouse control the particulate matter emissions from the dry slag processing operation, and failed to restore operations of its emission units to its normal or usual manner of operation as expediously as practice in accordance with good air pollution control practices for minimizing emissions.
As part of the settlement documented in the CAFO, Harsco will implement a fugitive dust emission plan to address all potential sources of fugitive particulate matter emissions at its facility. This CAFO also requires Harsco to pay a civil penalty in the amount of $69,398.00.
