On September 14, 2012, EPA Region 6 issued an Administrative Order on Consent (AOC) under its authority pursuant to CWA (33 U.S.C. Section 1251 et seq.) to Wheeler Brothers Feedyard located in Watonga, OK. The AOC was agreed to by both parties and issued in response to lagoon repairs. The AOC requires Wheeler Brothers Feedyard to continue monitoring and sampling all monitoring wells on a semi-annual basis and select production wells on an annual basis with the first event occurring on or before October 31, 2012, and the final event occurring on or before October 31, 2014. The facility is also required to submit a semi-annual report for each sampling event within forty-five (45) days of the last sample being collected for that sampling event. ODAFF issued a permit on 04/30/2015.
