On September 17, 2012, EPA Region 6 issued an Administrative Order on Consent (AOC) under its authority pursuant to CWA (33 U.S.C. Section 1251 et seq.) to T Bar M, L.L.C. located in Yuba, OK. The AOC requires T Bar M, L.L.C. to begin repairing the slumping under the HDPE liner in lagoon # 4 no later than October 1, 2012. All repairs need to be completed by January 15, 2013. It also requires that the facility obtain a certification by a professional engineer or equivalent that lagoon # 4 is not hydrologically connected to groundwater. T Bar M, L.L.C. must respond to EPA Region 6 and ODAFF within thirty (30) days following the completion of lagoon # 4 repairs, detailing construction activities along with certification of compliance to the Order.
