Respondent is the lessee and NYSDEC mine permit holder of a crushed stone and gravel facility located in Norwich, NY. Respondent failed to obtain coverage under the NYSDEC Multi-Sector General Permit for Stormwater Discharges associated with Industrial Activity and discharged without a Permit until coverage under the Permit was obtained on March 26, 2012. Stormwater discharges from the site to the Chenango River via a drainage ditch and culvert pipe, which passes beneath State Highway 12.
