On September 26, 2012, Region 5 executed a Consent Agreement and Final Order (CAFO) with Hometown Painting, Inc., located in Warrenville, Illinois. The CAFO commences and concludes a proceeding identifying alleged violations of Sections 402 and 406 of the Toxic Substances Control Act (TSCA), 15 U.S.C. §§ 2682 and 2686, and their implementing regulations at 40 C.F.R. Part 745. The CAFO alleges that Respondent failed to comply with the lead Renovation, Repair, and Painting Rule (RRP Rule) and the Pre-Renovation Education Rule (PRE Rule) in conducting a renovation on target housing. Specifically, the CAFO alleges that Respondent failed to comply with the following requirements: provide the owner of target housing with the EPA pamphlet titled Renovate Right: Important Lead Hazard Information for Families, Child Care Providers and Schools, implement work practice standards while performing the renovation to protect human health and the environment, and maintain records demonstrating compliance with the RRP and PRE Rules.
