This is an administrative penalty action pursuant to Section 112(r)(7) of the CAA issued to Aervoe Industries Inc. for violations occurring at its facility located in Gardnerville, NV. The violations involved failure to: maintain documentation of their hazard assessment; update and revalidate the process hazard analysis (PHA) every five years; certify annually that the operating procedures are current and accurate and that procedures have
been reviewed as often as necessary; correct deficiencies in equipment that were outside acceptable limits defined by the process safety information before further use or in a safe and timely manner when necessary means were taken to assure safe operation; and have procedures for informing the public and local emergency response agencies about accidental releases, all as required under Section 112(r)(7) of the CAA.
The Complaint / Consent Agreement establishes that Respondent will pay a penalty of $2,450.
