This Lighting Resources, LLC CAFO was issued based on a March 19, 2008 and a March 7, 2012 inspection by EPA Region 9. During the inspections, PCB violations related to continued use, marking, dating and notifying EPA of its PCB waste activities were documented. A penalty was assessed and the facility was required to pay a total of $71,500 for the alleged violations. The facility returned to compliance with TSCA and the PCB regulations on or near May 30, 2013.
This Civil Complaint will be issued pertaining to Polychlorinated Biphenyls ( PCB ) violations under the Toxic Substances Control Act ( TSCA ). Specifically , the facility continued to use PCBs prior to decontaminating their storage area, and improperly labeled PCB cotnainers in 2004 and 2008. These violations were based on EPA's 2004 and 2008 inspections when the facility was named Lighting Resources, Inc.
