This case addresses violations of the Clean Air Act (CAA) by Carter Brothers Mfg. Co., Inc. ( Carter Brothers ) , a importer of motor scooters located in Alabama. On April 28, 2008, Carter Brothers imported from Taiwan into the United States 36 motorized scooters. These vehicles failed to meet the requirements of the EPA issued Certificate of Conformity for the vehicles and were improperly labeled. The CAA requires that nonroad equipment be covered by an EPA issued Certificate of Conformity.
As part of the settlement with EPA, Carter Brothers paid a $10,000 civil penalty and the non-complying scooters back to the manufacturer in Taiwan.
