On October 17, 2012, EPA Region 10 filed a Consent Agreement and Final Order against Conoco Phillips Alaska, Inc. settling claims for violation of Section 311(b)(3) of the Clean Water Act, 33 U.S.C. 1321(b)(3). Conoco Phillips has agreed to pay a federal penalty of $45,000 and a state penalty of $77,000 to settle this matter, of which $45,000 will go to the federal Oil Spill Liability Trust Fund. The violation occurred on December 16, 2007, when Conoco Phillips Alaska, Inc. spilled approximately 102 barrels of crude oil and water at their Kuparuk River field.
