This case addresses violations of the Clean Air Act (CAA) by Pramac de Puerto Rico, Inc. ( Pramac ), an electrical apparatus and equipment wholesaler in Bayamon, Puerto Rico. From October of 2007 through August of 2010, Pramac imported 38 generators from Italy. 2 of the generators were not covered by an EPA-issued certificate of conformity as required by 40 C.P.R.§ 89.1003(a)(l)(ii) and 42 U.S.C. §§ 7522 and 7547. The other 36 generators did not have emissions labels as required by 40 C.F.R. § 1068.101(a)(l).
As part of the settlement with EPA, Pramac paid a $39,000 civil penalty and agreed to export the generators outside of the United States, Mexico or Canada.
