On May 13, 2013, Region 10 filed a Consent Agreement and Final order that resolves NPDES violations by the Gary Merlino Construction Company. The company is an industrial stormwater discharging facility permitted under the Washington State Industrial Stormwater General Permit. During an inspection conducted by EPA in March of 2012, the facility was found to be in violation of the general permit for failing to have covers on dumpsters and also for failing to implement the required treatment best management practices for zinc and turbidity in a timely manner. The compliance agreement requires Gary Merlino Construction Company to pay an administrative penalty of $36,000.
