On July 29, 2008, the EPA and Respondent entered into an Administrative Settlement Agreement and Order on Consent for Removal Action (2008 Agreement) for the site, pursuant to Sections 106 and 122 of CERCLA. EPA sought the response costs it incurred performing response activities at the site both before the Parties entered into the 2008 Agreement and after its completion.
