This is an administrative penalty action pursuant to Section 112(r)(7) of the CAA issued to Albertson's for the violation occuring at the Brea, CA Distribution Center facility. The violations involved failure to: 1) Assume the worst case release scenario to be the total quantity released over a period of 10 minutes; 2) Annually certify the operating procedures; 3) Provide refresher training to operators at least every three years; 4) ensure the frequency of inspections and tests of process equipment is consistent with applicable manufacturers' recommendations and good engineering practices; and 5) Correct defieinciencies that were outside acceptable limits defined by process safety information, all as required under Section 112(r)(7) of the CAA. The Complaint / Consent Agreement establishes that Respondent will pay a penalty of $5100.
