EPA is issuing an Administrative Compliance Order (ACO) Bristol-Myer Squibb Company and Amylin Ohio, L.L.C.?s (jointly, BMS) Hamilton facility for self-disclosed violations of the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Pharmaceuticals Production. Amylin Ohio, LLC is owned and operated by Bristol-Myers Squibb Company (BMS) due to a recent purchase. BMS submitted the self-disclosure through EPA's New Owner Voluntary Self-Disclosure Policy. Specifically, BMS self-disclosed that the previous owner did not implement the NESHAP for Pharmaceuticals Production at the Hamilton facility.
To resolve the violations, BMS has agreed to install three cryogenic condensers at its the Hamilton facility's two process lines and all the tanks at the tank farm to achieve a 98% reduction of HAPs emissions from these sources. In addition, the ACO establishes a compliance schedule for the Hamilton facility to implement the NESHAP for Pharmaceutical Production.
