Summary

2/6/14 - The United States seeks to recover all costs incurred in response to a release or threatened release of hazardous substances at or from a former glycol reprocessing facility at 3501 Gribble Road (the ?Site?). In addition, the United States seeks a declaratory judgment pursuant to Section 113(g)(2) of CERCLA, 42 U.S.C. ? 9613(g)(2), that all the defendants are jointly and severally liable for any future response costs, not inconsistent with the National Contingency Plan, 40 C.F.R. ? 300, that may be incurred by the United States in connection with the Site. The United States also seeks a judgment in rem against the Site under Section 107(l) of CERCLA, 42 U.S.C. ? 9613(l). Finally, the United States also seeks the assessment of civil penalties and injunctive relief against Chehade Boulos for his unreasonable failure to fully respond to EPA information requests submitted to him pursuant to Section 104(e)(2) of CERCLA, 42 U.S.C. ? 9604(e)(2).
