Pursuant to Section 309(a) of the Clean Water Act (CWA), EPA Region 10 has issued a compliance order by consent to the City of Troy (City) located in Troy, Idaho for violations of the CWA on March 10, 2014. From October 2008 through April 2009, the City had 67 violations of its NPDES permit, including E. coli and total residual chlorine. The CityÂs NPDES permit expired on April 13, 2009, due to the CityÂs not submitting a timely and complete permit application prior to their 2004 NPDES Permit expiration. From May 1, 2009 to present, the City has been discharging pollutants without a NPDES permit. A previous compliance order and information request was issued on August 11, 2010, requiring the City to comply with their expired permit and submit a permit application. On July 16, 2012 and March 25, 2013, EPA received the CityÂs Permit application materials. The compliance order being issued requires the City to take corrective actions, including the removal of sludge to achieve compliance with their effluent limits by October 31, 2017.
