The construction site in question is a small construction activity and is subject to State and Federal provisions regulating discharge of pollutants from the construction site. A TPDES permit was required to allow construction activity to be conducted at the site. The Operator of the Project started construction at the site without a permit. EPA, through this action, desires to bring the Project into compliance with applicable State and Federal regulations.
