The Consent Agreement and Final (CAFO) issued on November 19, 2013, alleges that Shintech failed to comply with generator standards, including exceedences of its notified generator status in violation of the laws and regulations of RCRA, discharged pollutants into waters of the United States in exceedence of its permit and violated the Clean Water Act requirements, and did not comply with the reporting requirements EPCRA. The CAFO assesses a penalty of $651,768.00.
