Respondent, Trivestco Energy Company, owned and operated an oil field waste disposal facility known as the Smith-Grell Tank Battery, located in Kay County, Oklahoma. On August 13, 2013, EPA inspectors observed oil field brine and producted wastewater from oil production activities, had been discharged from the facility to waters of the United States', without a permit.
