Summary

This case involves sixteen violations of the CAA by CSX, an international transportation company that offers a variety of rail, container-shipping, intermodal, trucking, and contract logistic services. Between February 12, 2008 and October 14, 2008, CSX remanufactured sixteen locomotive engines and placed them into service. The locomotives were remanufactured in 2008, and CSX intended that the locomotives would belong to engine family 8CSXK0710ES2. However, this engine family was never certified by the EPA. CSX removed the sixteen locomotives from service after discovering their violation. As part of the settlement CSX must pay a civil penalty of $98,000 to the United States Treasury and to install Automatic Engine Stop/Start System (AESS) on the sixteen remanufactured uncertified locomotives and on an additional 16 locomotives. AESS is a device that automatically shuts down an idling diesel engine and uses battery power to keep the locomotive in an operating state, ready to start on demand.
