EPA issued a Consent Agreement and Final Order (CAFO)to commence and conclude an action against Johnson Controls Battery Group, Inc. (Johnson Controls) for alleged violations of the Clean Air Act. The CAFO alleges that Johnson Controls violated various requirements of the Illinois State Implementation Plan, including lead emission limits included in construction permits and a federally enforceable state operating permit. The CAFO requires Johnson Controls to pay a $42,135 penalty and perform a $240,000 supplemental environmental project (SEP). The SEP consists of the replacement of oil mist filters at two lead melting furnaces with a new jet-pulse baghouse with secondary HEPA filters.
