On September 29, 2012, Region 1 filed a CAFO that both initiates and resolves a CAA enforcement action against DuBrul Family LLC, John A. DuBrul II, Manager of DuBrul Family, LLC and John DuBrul III, individually, and as Chief Executive Officer of DuBrul Family, LLC, located in Shelburne, Vermont. Respondents violated Section 112 of the CAA and the National Emission Standard for Hazardous Air Pollutants for Asbestos, 40 C.F.R. Part 61, Subpart M (Asbestos NESHAP) by failing to provide EPA with prior written notification of a demolition operation of a group of commercial and residential buildings in Shelburne. The CAFO requires Respondents to pay a civil penalty of $20,000 and to certify current compliance with Section 112 of the CAA and the Asbestos NESHAP.
