The Defendant has a history of significant violations and has been the subject of federal criminal and civil, as well as state enforcement actions. HQ requested, on behalf of Regions 2 and 4, initiation of a civil enforcement action for historical violations of the CAA, CWA, EPCRA, TSCA, and RCRA, identified through self-audits from 2001 and 2004 at the Atlantic States Cast Iron Pipe site in Region 2. The Consent Decree requires the Defendant to pay a civil penalty, including payment to the Oil Spill Trust Fund, as well as complete various compliance activities.
