On November 2, 2015, EPA Region 6 issued an Expedited Settlement Agreement (ESA) under its authority pursuant to the Clean Air Act to KMCO LLC The ESA was issued in response to violations of Section 112(r)(7) of the Clean Air Act and 40 CFR Part 68-Chemical Accident Prevention Provisions at the Crosby plant . The ESA requires KMCO LLC to pay an assessed penalty of $2,700 within 45 days of the receipt of the ESA.
