A proposed Consent Decree has been agreed to and signed by the Defendants, and has been entered in federal court. The settlement terms include corrective action requirements to bring the facilities into compliance. The proposed Decree requires the installation and continuous operation of BACT-level controls and/or enforceable BACT level emission rates at Lehigh plants to control NOx and SO2 emissions.
