This matter relates to a bankruptcy case which includes the sale of property owned by Badlands Energy, Inc. (formerly Gasco Energy, Inc.) and Badlands Production Company
to a new owner. The property is subject to a Consent Decree entered March 24,2014, in the case Gasco Energy, Inc. v. Environmental Protection Agency which resolved allegations concerning unauthorized discharges of dredged and fill material to wetlands. Under the terms of the Court Order, the sale of the property is subject to all requirements of the Consent Decree and the buyer shall complete the monitoring activities required by the Consent Decree and an EPA-approved restoration plan, and undertake all additional restoration activities necessary to comply with the restoration plan.
