On April 10, 2018, Region 1 filed a combined complaint and consent agreement simultaneously commencing and concluding an enforcement against Deer No No, Inc. (DNN) for an alleged violation of Section 7 of FIFRA, 7 U.S.C. ? 136e. The agreement alleges that DNN failed to file a timely annual pesticide production report for calendar year 2016 in connection with its registered establishment in Torrington, CT. DNN agreed to pay a civil penalty of $471 to resolve the violation. The FIFRA annual pesticide production reporting requirements are enforced federally and not by states under primacy or delegation.
