This is a Consent Agreement and Final Order (CA/FO) between US EPA and Del Monte Fresh Produce (West Coast), Inc, (Respondent), of Sanger, California. EPA alleges that Respondent violated Section 112(r)(1) of the Clean Air Act, Section 103 of the Comprehensive Environmental Response, Compensation, and Liability Act, and Section 304 of the Emergency Planning and Community Right-to-Know Act. As part of this settlement, Respondent agreed to pay a civil penalty of $80,000 and to perform a Supplemental Environmental Project (SEP) installing a new control system that will allow for remote shut off of valves as well as closer monitoring and notification of potential releases. The SEP must be at a cost of no less than $109,499 and be implemented within twelve months of this CA/FO.
